Veuillez lire attentivement les informations suivantes, qui décrivent les différences et les limites de notre service 911 comparé au service 911 traditionnel. En utilisant le service VOIP de BZ Télécom inc., vous reconnaissez que vous avez l’âge légal (18 ans ou plus), et vous acceptez les conditions énoncées ci-dessous. Si vous ne souhaitez pas accepter ces conditions, nous vous recommandons de ne pas utiliser pas le service VOIP fourni par BZ Télécom inc.

1. DIFFÉRENCE

Dans le cadre d’un service téléphonique traditionnel, l’appel au 911 est envoyé directement au Centre d’appels de la   sécurité publique (ci-après appelé « CASP » ) le plus proche de votre adresse. Dans le cas du Service voix sur IP, l’appel au 911 est envoyé à un tiers fournisseur de services qui l’acheminera automatiquement ou manuellement au CASP.

2. EMPLACEMENT

Comme vous vous déplacez d’un endroit à un autre avec votre Service voix sur IP, pour des raisons techniques, il se peut que le préposé du centre d’appels d’urgence ne dispose pas de vos nom, adresse ou numéro de téléphone au moment de l’appel. Lorsque vous utilisez le Service 911 voix sur IP, vous devez donc immédiatement fournir au préposé l’adresse du lieu où vous vous trouvez (ou l’adresse du lieu de la situation d’urgence, si elle diffère), et vos coordonnées. Ne courez pas le risque d’envoyer des services policiers ou ambulanciers au mauvais endroit.

3. INTERRUPTION DE SERVICE 

Le Service voix sur IP dépend non seulement du maintien de votre abonnement (et du paiement de vos factures), mais aussi de votre connexion Internet et de votre réseau de distribution d’électricité. En cas de panne d’électricité, d’Internet ou de réseau (y compris l’encombrement du réseau), ou en cas de débranchement en raison du non-paiement de vos factures, il se pourrait que vous ne puissiez pas accéder au 911 voix sur IP ou que vous ayez de la difficulté à y accéder. BZ Télécom inc. vous recommande de disposer d’un autre service téléphonique (comme un cellulaire) afin d’augmenter votre capacité à accéder au service d’urgence, en cas de perturbation du Service voix sur IP.

4. SUIVEZ LES INSTRUCTIONS DU PRÉPOSÉ

Ne raccrochez pas et ne mettez pas fin à votre appel au 911 voix sur IP avant que le répartiteur du centre d’appels d’urgence ne vous le permette. Si la ligne est coupée par inadvertance, rappelez immédiatement.

5. MISE À JOUR DE VOS RENSEIGNEMENTS 

Mettez à jour les renseignements qui figurent à votre dossier de Client. BZ Télécom inc. fera de son mieux pour fournir l’adresse qui figure à votre dossier de Client au préposé du centre d’appels d’urgence. Vous devez donc vous assurer que ces renseignements sont toujours exacts et à jour. Si vous ne communiquez pas votre adresse au préposé du centre d’appels d’urgence (p. ex. si vous êtes dans l’impossibilité de parler, lors d’un appel au 911), le préposé pourrait tenir pour acquis que vous téléphonez à partir du dernier numéro sauvegardé dans votre dossier de Client.

6. NOTIFICATION DES AUTRES UTILISATEURS 

Vous devez aviser vos employés ou les autres utilisateurs potentiels de votre Service voix sur IP de la nature et des limitations des appels d’urgence effectués au 911 par l’entremise du Service voix sur IP.

Conformément aux lois et à la règlementation applicable, vous devez informer adéquatement vos employés et autres utilisateurs potentiels des différences applicables aux appels d’urgence effectués au 911 par l’entremise du Service voix sur IP.

7. LIMITATION DE RESPONSABILITÉ ET INDEMNISATION  

Étant donné que les conditions du Service voix sur IP de BZ Télécom inc. limitent la responsabilité des personnes morales et déclinent toute responsabilité à l’égard du 911 voix sur IP, veuillez lire ce qui suit.

7.1 ABSENCE DE GARANTIE.  

 SOUS RÉSERVE DES PRÉSENTES DISPOSITIONS ET DU CONTRAT DE SERVICE CONCLU PAR VOUS ET PAR BZ TÉLÉCOM INC., DANS LE CADRE DUQUEL VOUS VOUS ABONNEZ AU SERVICE VOIX SUR IP, BZ TÉLÉCOM INC. N’OFFRE AUCUNE GARANTIE EXPRESSE OU TACITE DE QUELQUE NATURE QUE CE SOIT, Y COMPRIS, SANS RESTRICTION AUCUNE, TOUTE GARANTIE DE QUALITÉ.

7.2 LIMITATION DE RESPONSABILITÉ.  

BZ TÉLÉCOM INC., SES FILIALES OU SES SOCIÉTÉS AFFILIÉES AINSI QUE LEURS ADMINISTRATEURS, DIRIGEANTS, EMPLOYÉS, REPRÉSENTANTS AUTORISÉS OU MANDATAIRES NE PEUVENT PAS ÊTRE TENUS RESPONSABLES DE CE QUI SUIT :

A) LES SINISTRES, DOMMAGES OU PERTES (Y COMPRIS, SANS RESTRICTION, LES PERTES DE PROFITS); 

B) LES DOMMAGES RÉSULTANT DE L’INTERRUPTION DU SERVICE VOIX SUR IP OU DE LA PERTE DE DONNÉES.

À CET ÉGARD, EN VOUS ABONNANT AUX SERVICES VOIX SUR IP, VOUS RENONCEZ À TOUTE RÉCLAMATION OU CAUSE D’ACTION DÉCOULANT D’UNE INTERRUPTION DU SERVICE VOIX SUR IP OU EN LIEN AVEC CELLE-CI, OU DE L’INCAPACITÉ À FAIRE UN APPEL AU 911 VOIX SUR IP OU À COMMUNIQUER AVEC DU PERSONNEL DE SERVICES D’URGENCE, SAUF DANS LES CAS OÙ L’ACTE OU L’OMISSION À L’ORIGINE DE LA RÉCLAMATION, DES DOMMAGES OU DES PERTES CONSTITUE UNE NÉGLIGENCE OU UNE IMPRUDENCE GRAVE OU UN MÉFAIT INTENTIONNEL DE LA PART DE CONNECT IT. 

DÉDOMMAGEMENT: VOUS CONVENEZ DE DÉFENDRE ET DE DÉGAGER BZ TÉLÉCOM INC., SES FILIALES OU SES SOCIÉTÉS AFFILIÉES ET LEURS ADMINISTRATEURS, DIRIGEANTS, EMPLOYÉS, REPRÉSENTANTS AUTORISÉS, MANDATAIRES RESPECTIFS, ET LEURS AYANTS DROIT OU D’AUTRES FOURNISSEURS QUI OFFRENT DES SERVICES À LA CLIENTÈLE OU DES SERVICES À BZ TÉLÉCOM INC. RELATIFS AU SERVICE VOIX SUR IP, DE TOUTE RESPONSABILITÉ À L’ÉGARD DE RÉCLAMATIONS, PERTES, DOMMAGES, AMENDES, PÉNALITÉS, COÛTS, DÉPENSES, FRAIS JURIDIQUES, ETC., EN VOTRE NOM, AU NOM D’UN TIERS, OU AU NOM D’UN UTILISATEUR DE VOTRE SERVICE VOIX SUR IP QUANT À L’ABSENCE, À UNE PANNE OU À UNE INTERRUPTION DU SERVICE VOIX SUR IP, Y COMPRIS LE 911 VOIX SUR IP OU À VOTRE INCAPACITÉ OU À CELLE D’UN TIERS OU DE TOUT AUTRE UTILISATEUR DU SERVICE À COMMUNIQUER AVEC LE 911 OU AVEC LE PERSONNEL DES SERVICES D’URGENCE, ET AUX APPELS AU 911 ACHEMINÉS ERRONÉMENT.

8. ACCEPTATION 

En plus des limitations abordées ci-dessus, que vous avez lues et comprises, et des limites de responsabilité de Bz télécom inc., vous reconnaissez et acceptez par la présente, sans restriction, le Service voix sur IP et le Service 911 voix sur IP, tels qu’ils sont actuellement offerts.

9. AVERTISSEMENT 

Lorsque vous composez le 911, soyez prêt(e) à fournir l’adresse du lieu où vous vous trouvez.

10. CONSEILS AUX UTILISATEURS : RENSEIGNEMENTS IMPORTANTS SUR LE 911 

En cas d’urgence : 

i) composez le 911 pour communiquer avec un préposé au centre d’appels d’urgence;  

ii) soyez prêt(e) à fournir votre adresse (le lieu où il y a une urgence), un numéro où vous rappeler et la nature de l’urgence; 

iii) ne raccrochez pas avant que le préposé ou qu’une personne du centre d’appels ne vous dise de le faire; 

iv) si la communication est interrompue, recomposez immédiatement le 911; par ailleurs, le préposé tentera de vous rappeler au numéro que vous lui avez fourni;  

v) assurez-vous que votre Service voix sur IP et que votre service Internet sont configurés et initialisés correctement; 

vi) apposez, bien en vue, les autocollants fournis dans votre trousse de démarrage sur vos appareils utilisant le Service voix sur IP ou à un endroit bien visible de tous les utilisateurs actuels ou potentiels; 

vii) avisez tous les utilisateurs actuels ou potentiels des limites du 911 voix sur IP et fournissez-leur les conseils susmentionnés.

11. AUTRES DISPOSITIONS 

11.1 Modifications. BZ 

BZ télécom inc. pourrait, en tout temps et à son entière discrétion, modifier cet avis. Le cas échéant, Bz Télécom inc. affichera un avis à cet égard sur son site Web, au bas de la page, et cette modification prendra effet à la date de la modification de la Politique. Bz Télécom inc. n’assume aucune responsabilité envers vous quant à la non-conformité du présent avis.

11.2 Lois applicables.  

Le présent avis est régi par les lois applicables du Québec. Les parties reconnaissent la compétence exclusive des tribunaux du Québec à l’égard de toute question abordée aux présentes et conviennent de s’y conformer. 

11.3 Inapplicabilité.   

Si un tribunal compétent déclare qu’une disposition des présentes est non valide, illégale ou inexécutoire de quelque façon que ce soit, les autres dispositions ne seront pas touchées et resteront en vigueur

11.4 Défaut.   

Le défaut de Bz Télécom inc. d’exiger  le respect absolu des conditions de cet avis ne constitue pas sa renonciation à un recours pour violation et ne l’empêchera pas, ultérieurement, d’exiger  le respect absolu de cette modalité, ni ne constituera une renonciation à toute sanction pour une violation subséquente, de même nature ou non.

911 VOIP Warning

Please read the following information carefully, which describes the differences and limitations of our 911 service compared to traditional 911 service. By using BZ Télécom Inc.’s VOIP service, you acknowledge that you are of legal age (18 years or older), and you agree to the terms stated below. If you do not wish to accept these conditions, we recommend that you do not use the VOIP service provided by BZ Télécom Inc.

1. DIFFERENCE

With a traditional telephone service, the 911 call is sent directly to the Public Safety Answering Point (hereinafter referred to as « PSAP ») closest to your address. In the case of the Voice over IP Service, the 911 call is sent to a third-party service provider who will automatically or manually route it to the PSAP.

2. LOCATION

As you move from one place to another with your Voice over IP Service, for technical reasons, the emergency call center attendant may not have your name, address, or phone number at the time of the call. Therefore, when using the Voice over IP 911 Service, you must immediately provide the attendant with the address of your location (or the address of the emergency situation if it is different) and your contact details. Do not risk sending police or ambulance services to the wrong location.

3. SERVICE INTERRUPTION

The Voice over IP Service depends not only on maintaining your subscription (and paying your bills) but also on your Internet connection and your power distribution network. In the event of a power outage, Internet failure, or network congestion, or if you are disconnected due to non-payment of your bills, you may not be able to access the Voice over IP 911 or may have difficulty doing so. BZ Télécom Inc. recommends having another telephone service (such as a cell phone) to increase your ability to access emergency services in case of a disruption to the Voice over IP Service.

4. FOLLOW THE ATTENDANT’S INSTRUCTIONS

Do not hang up or end your Voice over IP 911 call until the emergency call center dispatcher allows you to do so. If the line is accidentally cut, call back immediately.

5. UPDATE YOUR INFORMATION

Update the information in your Customer file. BZ Télécom Inc. will do its best to provide the address in your Customer file to the emergency call center attendant. Therefore, you must ensure that this information is always accurate and up to date. If you do not communicate your address to the emergency call center attendant (e.g., if you are unable to speak during a 911 call), the attendant may assume that you are calling from the last number saved in your Customer file.

6. NOTIFY OTHER USERS

You must inform your employees or other potential users of your Voice over IP Service about the nature and limitations of emergency calls made to 911 through the Voice over IP Service.

In accordance with applicable laws and regulations, you must adequately inform your employees and other potential users of the differences applicable to emergency calls made to 911 through the Voice over IP Service.

7. LIMITATION OF LIABILITY AND INDEMNIFICATION  

Since the conditions of BZ Télécom Inc.’s Voice over IP Service limit the liability of legal entities and disclaim any liability regarding the Voice over IP 911, please read the following.

7.1 NO WARRANTY  

SUBJECT TO THESE PROVISIONS AND THE SERVICE AGREEMENT CONCLUDED BETWEEN YOU AND BZ TÉLÉCOM INC., UNDER WHICH YOU SUBSCRIBE TO THE VOICE OVER IP SERVICE, BZ TÉLÉCOM INC. OFFERS NO EXPRESS OR IMPLIED WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF QUALITY.

7.2 LIMITATION OF LIABILITY 

BZ TÉLÉCOM INC., ITS SUBSIDIARIES, OR AFFILIATED COMPANIES, AS WELL AS THEIR DIRECTORS, OFFICERS, EMPLOYEES, AUTHORIZED REPRESENTATIVES, OR AGENTS CANNOT BE HELD LIABLE FOR:

A) CLAIMS, DAMAGES, OR LOSSES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS);

B) DAMAGES RESULTING FROM THE INTERRUPTION OF THE VOICE OVER IP SERVICE OR LOSS OF DATA.

IN THIS REGARD, BY SUBSCRIBING TO THE VOICE OVER IP SERVICES, YOU WAIVE ANY CLAIM OR CAUSE OF ACTION ARISING FROM AN INTERRUPTION OF THE VOICE OVER IP SERVICE OR RELATED TO IT, OR THE INABILITY TO MAKE A VOICE OVER IP 911 CALL OR TO COMMUNICATE WITH EMERGENCY SERVICE PERSONNEL, EXCEPT IN CASES WHERE THE ACT OR OMISSION CAUSING THE CLAIM, DAMAGES, OR LOSSES CONSTITUTES GROSS NEGLIGENCE, RECKLESSNESS, OR WILLFUL MISCONDUCT BY CONNECT IT.

INDEMNIFICATION: YOU AGREE TO DEFEND AND HOLD BZ TÉLÉCOM INC., ITS SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AUTHORIZED REPRESENTATIVES, AGENTS, AND ASSIGNS OR OTHER PROVIDERS WHO PROVIDE CUSTOMER SERVICES OR SERVICES TO BZ TÉLÉCOM INC. RELATED TO THE VOICE OVER IP SERVICE, HARMLESS FROM ANY LIABILITY FOR CLAIMS, LOSSES, DAMAGES, FINES, PENALTIES, COSTS, EXPENSES, LEGAL FEES, ETC., ON YOUR BEHALF, ON BEHALF OF A THIRD PARTY, OR ON BEHALF OF A USER OF YOUR VOICE OVER IP SERVICE DUE TO THE ABSENCE, FAILURE, OR INTERRUPTION OF THE VOICE OVER IP SERVICE, INCLUDING THE VOICE OVER IP 911, OR YOUR INABILITY OR THAT OF A THIRD PARTY OR ANY OTHER USER OF THE SERVICE TO COMMUNICATE WITH THE 911 OR EMERGENCY SERVICE PERSONNEL, AND ERRONEOUSLY ROUTED 911 CALLS.

8. ACCEPTANCE

In addition to the limitations discussed above, which you have read and understood, and the limitations of liability of BZ Télécom Inc., you hereby acknowledge and accept, without restriction, the Voice over IP Service and the Voice over IP 911 Service as they are currently offered.

9. WARNING

When you dial 911, be prepared to provide the address of your location..

10. USER ADVICE: IMPORTANT INFORMATION ABOUT 911 

In case of emergency:

i) Dial 911 to communicate with an emergency call center attendant;

ii) Be prepared to provide your address (the location of the emergency), a callback number, and the nature of the emergency;

iii) Do not hang up before the attendant or someone from the call center tells you to do so;

iv) If the call is disconnected, immediately redial 911; moreover, the attendant will try to call you back at the number you provided;

v) Ensure that your Voice over IP Service and your Internet service are configured and initialized correctly;

vi) Place the provided stickers from your starter kit visibly on your devices using the Voice over IP Service or in a highly visible location for all current or potential users;

vii) Inform all current or potential users of the limitations of the Voice over IP 911 and provide them with the aforementioned advice.

11. OTHER PROVISIONS 

11.1 Changes 

BZ Télécom Inc. may, at any time and at its sole discretion, modify this notice. In such cases, BZ Télécom Inc. will post a notice to this effect on its website at the bottom of the page, and the modification will take effect on the date of the policy change. BZ Télécom Inc. assumes no responsibility towards you regarding non-compliance with this notice.

11.2 Applicable Laws  

This notice is governed by the applicable laws of Quebec. The parties acknowledge the exclusive jurisdiction of the Quebec courts with respect to any matter addressed herein and agree to comply with it.

11.3 Non-Enforceability  

If a competent court declares any provision herein invalid, illegal, or unenforceable in any way, the other provisions will not be affected and will remain in force.

11.4 Default

BZ Télécom Inc.’s failure to strictly enforce the conditions of this notice does not constitute a waiver of recourse for violation and does not prevent it from subsequently requiring strict compliance with this condition, nor does it constitute a waiver of any penalty for subsequent violations, whether similar or not.
